With the increase in short-term rentals for tourism purposes (through platforms like Airbnb) in recent years, the need for legal regulations has emerged, and significant changes have been introduced with a new law that went into effect on January 1, 2024.
with Law No. 7464 and its associated regulations, short-term rentals are now subject to specific permit and documentation requirements. Under this regulation:
• A “Tourism Rental Permit” from the Ministry of Culture and Tourism is mandatory for all rentals of less than 100 days.
• If the building contains more than one independent unit, unanimous approval from all apartment owners is required.
• After obtaining the permit, a plaque displaying the permit must be hung at the entrance of the property.
With this new system, substantial administrative fines have been imposed on those operating unauthorized rentals. Initial fines for undocumented rentals can range from 100.000 TL, to 500.000 TL and even up to 1.000.000 TL if they persist.
Furthermore, intermediaries and platforms that negotiate rental agreements are also held accountable, and sanctions, including access bans, have been imposed on websites that publish unauthorized listings.
Those renting short-term rentals must also be mindful of their tax obligations. Declaring and invoicing these incomes is mandatory.
Consequently, it is crucial for those wishing to rent their property through Airbnb and similar systems to properly comply with both administrative permits and tax obligations. Failure to do so could result in significant fines and legal action.
